User Responsibilities
Users, organizations, institutions, clients, and platform operators agree not to misuse services, compromise platform security, attempt unauthorized access, interfere with infrastructure operations, or violate applicable laws.
- Maintain confidentiality of credentials and access tokens.
- Ensure lawful usage of all deployed systems.
- Avoid malicious activities, reverse engineering, or abuse.
- Maintain responsibility for uploaded or processed data.
Intellectual Property
All software systems, infrastructure frameworks, UI components, workflows, source code, branding assets, architecture patterns, operational methodologies, analytics logic, and proprietary technologies developed by Ponykaams remain intellectual property of the company unless otherwise agreed in writing.
Healthcare & Operational Systems
Certain solutions provided by Ponykaams may interact with healthcare institutions, hospitals, diagnostic centers, NGOs, medical operations, research programs, or operational workflows.
Important Compliance Notice
Ponykaams does not provide medical diagnosis, clinical advice, emergency response services, or direct healthcare treatment. Institutions remain responsible for operational compliance, patient handling, medical decisions, and regulatory adherence.
Limitation of Liability
Ponykaams shall not be liable for indirect, incidental, consequential, operational, business, infrastructure, or data losses arising from platform usage, third-party integrations, downtime events, cyber incidents, user misuse, external attacks, or regulatory non-compliance by clients.
Services are provided on a commercially reasonable basis without guarantees of uninterrupted availability.
Platform Availability
Platform access, APIs, operational systems, dashboards, or infrastructure services may occasionally experience upgrades, maintenance windows, deployments, outages, or operational interruptions.
Ponykaams reserves the right to modify, suspend, improve, discontinue, or replace services at any time.
Suspension & Termination
Ponykaams may suspend, restrict, or terminate platform access where misuse, suspicious activity, security risks, operational abuse, legal violations, or infrastructure threats are detected.
Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of India.
Any disputes arising in connection with these services shall be subject to the jurisdiction of courts located in Telangana, India.
Modifications to Terms
Ponykaams reserves the right to revise, update, or modify these Terms of Service at any time without prior notice. Continued use of services after changes become effective constitutes acceptance of the revised terms.
