These Terms of Service (“Terms”) govern your access to and use of the website at ponykaams.com and the professional services provided by Ponykaams (OPC) Private Limited, a company incorporated under the Companies Act, 2013 in Hyderabad, Telangana, India (“Ponykaams”, “we”, “us”, or “our”). By accessing this website or engaging our services, you agree to be bound by these Terms.

1. Services

Ponykaams provides enterprise automation systems, custom SaaS platforms, Google Workspace solutions, Firebase and BigQuery implementations, payment gateway integrations, and related technology services. Specific deliverables, timelines, pricing, and acceptance criteria are defined in individual project agreements or statements of work executed between Ponykaams and the client.

2. Website Use

• You may not use this website to transmit harmful, offensive, or unlawful content
• You may not attempt to gain unauthorized access to any part of our website or systems
• You may not reproduce, distribute, or commercially exploit website content without prior written consent

3. Intellectual Property

All content on this website, including text, design, graphics, code, and the Ponykaams brand, is the exclusive intellectual property of Ponykaams (OPC) Private Limited and is protected under applicable intellectual property laws.

For client projects, intellectual property ownership is governed by the specific project agreement. Unless otherwise stated in writing, upon full payment of all invoices, the client receives full ownership of the custom-developed system and all associated source code. Ponykaams retains no continuing ownership, licensing rights, or access to client systems post-delivery.

4. Project Engagements

All professional service engagements are subject to a separate written agreement that will specify:

• Detailed scope of work and technical deliverables
• Project timeline and milestone schedule
• Fees, payment schedule, and accepted payment methods
• Acceptance criteria and handover procedures
• Post-delivery support terms if applicable

No project will commence without a signed agreement and receipt of any required advance payment.

5. Payment Terms

Payment terms are specified in individual project agreements. Generally, payments are structured across project milestones. Invoices are due within the timeframe stated on the invoice. Late payments may attract interest as permitted under applicable Indian law. Ponykaams reserves the right to suspend work on engagements with overdue payments.

6. Confidentiality

Both parties agree to maintain the confidentiality of non-public information shared during the engagement. Ponykaams will not disclose client project details, organizational data, or proprietary information to third parties without express written consent, except as required by law.

7. Limitation of Liability

To the maximum extent permitted by law, Ponykaams shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or our services. Our total aggregate liability for any claim relating to services shall not exceed the total fees paid by the client for the specific project giving rise to the claim, in the six months preceding the incident.

8. Disclaimer of Warranties

This website and its content are provided “as is” without warranty of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

10. Modifications

We reserve the right to modify these Terms at any time. Changes are effective upon posting to this page with an updated “Last Updated” date. Continued use of the website or our services after changes constitutes acceptance.
